Professional Investment Group Terms & Conditions

This page sets out the terms and conditions of your membership with the Professional Investment Group (the Group). Please read these terms and conditions carefully and make sure that you understand them before making an application for membership to the Group (Membership). You should understand that by making an application for Membership, you agree to be bound by these terms and conditions.

Please click on the button marked “I Accept” at the end of these terms and conditions if you accept them. Please understand that if you refuse to accept these terms and conditions, you will not be able to subscribe for Membership.

  1. Membership Availability

In consideration of you paying the subscription fee, we will provide you with Membership to our Site which will allow you to receive specially discounted contract prices on products and services relating to investment. This discount can be used with the partners (Partner) whom we engage with and is subject to availability or any variations to the discount made by them.

  1. Levels of Membership

2.1 There are three levels of Membership of the Group and the subscription fee will be based upon the level of Membership to which you qualify and may be subject to change. The memberships are as follows:

Bronze – annual fee £149.00
Silver – annual fee £299.00
Gold – annual fee £499.00

2.2 The subscription fee is to be paid along with submission of your application for Membership or with renewal of your current membership. Payment for all Memberships must be by PayPal Recurring Subscription.

2.3 The minimum length of membership is one year which may be paid either in full in advance or by equal monthly installments, payable on the first working day in advance. For the avoidance of doubt, in the event the member seeks to cancel their membership during the initial period of one year they are liable to account to the Group for the balance of their annual membership fee that remains unpaid.

2.4 If a member’s membership renewal becomes unpaid for longer than 7 days the Group has the right to cancel that membership.

2.5 The PayPal Recurring Payments will only be used to cover Membership transactions such as Subscriptions, Renewal Fees, Membership Level Upgrades, and Re-joining Fees.

2.6 At the end of the initial membership period and any successive 12 months membership the member’s subscription shall automatically renew for a further period of 12 months and the Group shall invoice the member at the then current rate and the member shall pay such subscription fee using the same method that they have paid the previous years’ membership.

2.7 a member may, by giving not less than 1 months’ notice, served no earlier than one month before the expiry of a membership period, cancel their membership by serving notice in accordance with clause 11 to the Group.

  1. Membership status

3.1 By applying for Membership and paying the subscription fee, you warrant that:

3.1.1 you are legally capable of entering into binding contracts;

3.1.2 you are at least 18 years old;

3.1.3 all goods or services purchased are for use in connection with your own
portfolio of properties and for no other properties;

3.1.4 you will not resell any goods so purchased;

3.1.5 you will not permit your Membership to be used by any third party whatsoever unless previously agreed with the Group.

  1. Partner Status

The Group reserves the right to substitute current Partners with suitable alternatives who will provide similar goods and/or services to the Members. The Group will provide notice within reasonable time to all Members per clause 11 to any changes of the Partners.

  1. Commencement of Membership

After submitting your application for Membership and payment of your subscription
fee is received you will receive an e-mail from us acknowledging that we have received your application. Membership will only be formed once we have contacted you specifically confirming your membership to the Group.

  1. Professional Investment Group Status

6.1 Any orders for products or services are to be placed with the Partners directly. The resulting legal contract is between you and that Partner and is subject to such terms and conditions that the Partner advises.

6.2 We are not a party to your contract with the Partners and do not give any warranty that any products or services you purchase or receive from them through your membership of the Group will be of merchantable or satisfactory quality or are suitable for the purposes you require and any such warranties are disclaimed by us absolutely.

6.3 This disclaimer does not affect your statutory rights against a Partner.

  1. Partner Use

7.1 Partners shall use the Portal as provided in these Terms. Use shall be in accordance with all applicable privacy and data protection laws, and you agree not to further disclose any of the data relating to our Members to any third party.

7.2 Partners shall not use Member information provided to them by the Group;

7.2.1 any purpose other than providing the service or product which that Partner specifically provides; or

7.2.2 Making unsolicited communication including, but not limited to, phone calls, emails, post or newsletters or to contact any Member unless they have agreed to be contacted.

7.3 Partners shall indemnity themselves against all risk associated with the product and/or service they provide to the Members and shall maintain appropriate insurance cover for the duration of dealings with the Members as suitable for that product and/or service.

  1. Termination of Membership

8.1 Your Membership will terminate immediately on the occurrence of the following
events:

8.1.1 Upon the expiry of the Membership and no renewal being applied for; and

8.1.2 When you terminate the Membership by giving written notice to us to that
effect; and

8.1.3 Upon a breach by you of any of your obligations contained herein. Any such
breach will result in a lifetime ban for Membership for you and your
immediate family and any other known recipient.

8.2 On termination of Membership for any reason any discount to which you might
have been entitled under Membership will cease and any products or services bought from the Partners from the date of termination will not have a discount applied.

8.4 You have the right to cancel your Membership and receive a full refund within 14 days of the Group provided you have not ordered and/or purchased any goods or services subject to the special prices or discounts agreed with the Partners.

8.5 A valid receipt of payment via Paypal is required in order to cancel membership and receive a refund.

8.6 The Group may decide to cancel and refund your Membership due to various reasons, for example, but not limited to, misconduct, complaints from other members etc. and this cancellation may extend to being banned from attending PIG meetings. This will be put in writing to you and the ban would take effect immediately. Refunds would be issued via the method you paid originally and paid to you within 7 days, less any deductions for months in use e.g. if your Membership has been running for 6 months, then you will have a deduction of 6 months from the total refund. You may not continue using the benefits entitled with the Membership nor will you claim to be part of the Membership. Cancelling a Membership and banning from the group is entirely at the discretion of the Group. All decisions made by the Group are final.

  1. Group liability

9.1 Subject to clause 9.3, our entire liability to you will not exceed the amount of your Membership subscription.

9.2 The Group shall not be liable for the services, products, opinions or any other undertaking whatsoever of the Partners or their agents.

9.3 Nothing in this agreement excludes or limits our liability for:

9.3.1 death or personal injury caused by our negligence;

9.3.2 fraud or fraudulent misrepresentation;

9.4 Subject to clause 9.3 above we will have no liability to you by reason of any
representation (unless fraudulent) or any implied warranty condition or other term or
any duty at common law for loss of profit or for any indirect special or consequential
loss or damage costs expenses or other claims for compensation whatsoever arising
under or in connection with these terms and conditions or the Membership.

  1. Privacy

10.1 The Group will hold personal information of the Members limited to full name and email address.

10.2 We use Paypal as our payment processing partner. Your Paypal account data is held in accordance with their privacy policy.

10.3 In agreeing to use Paypal the Members acknowledge their Paypal account residential address will be visible to the Group on receipt of payment. The Group will not pass this information on to any of the Partners or any of other third party.

10.4 We do not receive or store any financial data of the Members or Partners, nor do we share this information with any third parties.

10.5 The Group reserves the right to modify this privacy policy at any time giving Members sufficient notice of this.

  1. Notices

11.1 Some information or communications we send to you should be in writing. When becoming a member, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

11.2 All notices given by you to us must be given to Professional Investment Group. HM Williams, Valley House, 53 Valley Rd, Plymouth PL7 1RF or hello@pig.network.

11.3 Notice may be given to you using the email address provided by you on commencement of your Membership.

  1. Transfer of Membership

Membership of our Site is personal to you. You may not transfer, assign or otherwise
dispose of your Membership, or any of your rights, privileges or obligations arising
under it, without our prior written consent from the Group.

  1. Waiver

13.1 If we fail, at any time during the period of your Membership to insist upon strict
performance of any of your obligations of Membership or any of these terms and
conditions, or if we fail to exercise any of the rights or remedies to which we are
entitled hereunder, this will not constitute a waiver of such rights or remedies and will
not relieve you from compliance with such obligations.

13.2 A waiver by us of any default will not constitute a waiver of any subsequent default.

13.3 No waiver by us of any of these terms and conditions will be effective unless it is
expressly stated to be a waiver and is communicated to you in writing.

  1. Severability

If any of these terms and conditions or any provisions of your Membership are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

  1. Entire agreement

15.1 These terms and conditions and any document expressly referred to in them
constitute the whole agreement between us and supersede all previous discussions,
correspondence, negotiations, previous arrangement, understanding or agreement
between us.

15.2 We each acknowledge that, in entering into the Contract, neither of us relies on, or
will have any remedies in respect of, any representation or warranty (whether made
innocently or negligently) that is not set out in these terms and conditions or the
documents referred to in them.

15.3 Each of us agrees that our only liability in respect of those representations and
warranties that are set out in this agreement (whether made innocently or negligently)
will be for breach of contract.

15.4 Nothing in this clause limits or excludes any liability for fraud.

  1. Variation of Terms

16.1 We have the right to revise and amend these terms and conditions from time to time
to reflect changes in market conditions affecting our business, changes in technology,
changes in payment methods, changes in relevant laws and regulatory requirements
and changes in our system’s capabilities.

16.2 You will be subject to the policies and terms and conditions in force from time to time
during the period of your Membership.

  1. Law and jurisdiction

Any dispute or claim arising out of or in connection with the Site (including non-contractual
disputes or claims) will be governed by English law and will be subject to the non-exclusive
jurisdiction of the courts of England and Wales.

  1. Third party rights

A person who is not party to these terms and conditions or a Contract shall not have any
rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.
